How long does it take to settle a compensation claim

As the saying goes, “How long is a piece of string”? Every type of claim is different.  No one can give you an accurate answer on how long a compensation claim should take, as there are numerous factors which can delay settlement of your compensation claim.

For the most simple road traffic accident claims using the “RTA Portal” means that claims can be settled in a matter of just a few months – if not sooner.

For other personal injury claims where liability is not disputed and the injuries are relatively minor then you are probably looking at somewhere between 3 to 9 months, and for cases that are complicated, involve serious injuries or if liability is disputed then you are looking at 12 months +, and if you have to go to court then your claim may run into years.

You should be aware that even in the most simple cases Defendants and/or their insurance company can be frustratingly slow in dealing with correspondence. This can mean that the time to settlement of your claim will be longer than it should be.

Sadly, while getting on with your life and getting justice may be at the forefront of your mind, you will probably be one of hundreds of claims being dealt with by the insurers ‘claims handler’ appointed to deal with your claim.  If you have instructed a solicitor to deal with your claim then you can rest assured that they will be hounding the insurers to deal with your claim (after all, if they are acting on a ‘no win, no fee basis’ they will receive their payment until sometime after your case settles – and like most business ‘cash flow is king’), but if you are going it alone don’t be surprised if you find yourself making numerous telephone calls asking for updates and be prepared for being fobbed-off by an over-worked claims handler!
